1. Introduction and Acceptance

This Privacy Policy (“Policy”) describes how Miller-Tippens Construction Company, LLC (“Miller-Tippens,” “Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you visit miller-tippens.com (the “Site”) or otherwise interact with us online.

By accessing or using the Site, you acknowledge that you have read this Policy. Where applicable law requires your affirmative consent before certain data collection begins — including before non-essential cookies, analytics, or advertising technologies load — we obtain that consent through the cookie consent tool described in Section 4, not merely through your continued browsing of the Site.

This Policy applies to all visitors to the Site, including prospective clients, subcontractors, vendors, job applicants, and any other users, regardless of the device used to access it.

2. Information We Collect

2.1 Information You Provide Directly

Contact form. When you submit our Contact Us form, we collect: first and last name, email address, phone number, your message, and your response to “How did you hear about us?” (Search Engine, Friends or Family, Business Referral, or Other).

Job applications. Miller-Tippens does not currently operate an online application portal. Applicants apply by emailing a resume directly to info@miller-tippens.com in response to posted openings (e.g., Project Manager, Assistant Project Manager, Superintendent, Carpenter). Information collected this way (name, contact details, resume/work history, and any other information voluntarily included) is handled as an email communication under our standard email retention and security practices, not as Site-collected form data.

Other direct submissions. Any other information you voluntarily provide by emailing us, calling our offices, or otherwise contacting us directly.

2.2 Information Collected Automatically

When you visit the Site, certain information is collected automatically through your browser and device, including:

  • IP address and approximate geographic location (state/city/region)
  • Browser type, version, and language settings
  • Device type, operating system, and screen resolution
  • Referring/exit pages and URLs
  • Pages viewed, links clicked, time spent on pages, and navigation paths
  • Date and time of visit

This information is collected using cookies, pixels, and similar tracking technologies described in Section 4, and is used for the purposes described in Section 3 — it is not used to individually identify visitors by name.

2.3 Third-Party and Embedded Content

Embedded video (YouTube). The Site embeds YouTube videos — including client project testimonials — via our YouTube channel. Embedded videos are presented as a thumbnail image with a prompt to accept Marketing cookies; the video player and any associated YouTube data collection do not load until you click to accept. Our homepage hero video is self-hosted (served directly from our own website files) and does not involve YouTube or any third-party video platform.

Social media links. The Site links to our Facebook, Instagram, and YouTube profiles. These are outbound links only — visiting them is governed by that platform’s own privacy policy, not this one, and no data is exchanged with those platforms merely by your presence on our Site unless you affirmatively click through.

When you interact with any embedded third-party content, the third-party operator may independently collect information in accordance with its own privacy policy. We do not control, and are not responsible for, the data practices of these third parties.

3. How We Use Information

We use the information described above to:

  • Respond to inquiries submitted through our Contact Us form or received by phone or email
  • Evaluate resumes and applications for open positions
  • Operate, maintain, secure, and improve the Site
  • Understand how visitors use the Site (analytics) to improve content and user experience
  • Measure the effectiveness of our marketing and outreach efforts
  • Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity
  • Comply with legal obligations and enforce our agreements

4. Cookies, Tracking Technologies, and Analytics

This section provides specific, conspicuous disclosure of the tracking technologies used on the Site and documents how consent is obtained, consistent with the California Invasion of Privacy Act (“CIPA,” Cal. Penal Code §§ 631, 632, 638.50–638.51) and comparable state and federal privacy laws.

4.1 What Are Cookies and Tracking Technologies

“Cookies” are small text files placed on your device by a website. “Tracking technologies” more broadly includes cookies, pixels, tags, and similar mechanisms that collect or store information about your device and your interactions with a website.

4.2 Categories of Cookies We Use

  • Essential — Necessary for the Site to function, including remembering your cookie consent choices. Cannot be disabled.
  • Statistics — Collects pseudonymized data about Site usage (Google Analytics) to help us understand and improve the Site. Off by default; requires consent.
  • Marketing — Supports advertising measurement and embedded video content (Google Ads, YouTube). Off by default; requires consent.

Google Analytics acts as our service provider for the sole purpose of helping us understand Site usage. It is not authorized to use this data for its own independent purposes. No Miller-Tippens employee, agent, or contractor reviews individual visitor sessions in real time, and Google Analytics does not record keystrokes or session replay video on this Site. You may opt out via the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout), our cookie consent tool (Section 4.5), or your browser settings (Section 4.6).

Marketing — Google Ads / DoubleClick and Google Advertising Infrastructure

Loads only after consent to the Marketing category. This category includes requests to googleads.g.doubleclick.net/pagead/id (advertising measurement) and Google’s supporting advertising-infrastructure calls (including Google’s Web Application Attestation service, used by Google to verify legitimate traffic to its advertising and video systems).

Marketing — YouTube

Embedded videos display as a thumbnail with a consent prompt (“Click here to accept Marketing cookies and load this content”). The video player, and any telemetry sent to youtube.com, do not load until you click to accept.

Hosting Infrastructure

Our hosting provider’s platform (GoDaddy/Secureserver) may run technical scripts (csp.secureserver.net/eventbus/web) as part of underlying server infrastructure. [CONFIRM WITH HOSTING PROVIDER: purpose of this script, whether it is strictly necessary for site delivery/security or should be classified as non-essential and gated behind consent like the categories above. Because our on-site consent tool may not have the technical ability to block scripts injected at the hosting/infrastructure level, this should be raised directly with GoDaddy/Secureserver to determine whether it can be disabled, deferred, or documented as strictly necessary.]

4.4 Other Tracking Technologies

We do not use chat widgets, session-replay software, keystroke loggers, or call-tracking/recording software on the Site. If we add such a tool in the future, we will update this Policy and provide notice before it activates.

4.5 Cookie Consent Management

Miller-Tippens uses WPConsent to give visitors notice of, and control over, non-essential cookies. Through the consent tool, available on the Site, you can accept or reject the Statistics and Marketing categories (Essential cookies cannot be disabled) and change your preferences at any time.

4.6 Browser and Device Controls

Most browsers let you block or delete cookies through browser settings; disabling cookies may affect Site functionality. The Site does not respond to “Do Not Track” signals but will honor recognized opt-out preference signals (e.g., California’s Global Privacy Control) where required by law.

5. Disclosure Regarding Electronic Communications and Consent to Monitoring

To directly address CIPA and comparable electronic-surveillance statutes:

  • This Policy provides advance notice that interactions with the Site — page views, clicks, form submissions, and related metadata — may be recorded and transmitted to Miller-Tippens and its service providers for the purposes described herein, subject to the consent requirements in Section 4.
  • Any third party processing Site data does so as our service provider, under terms restricting its use of that data to providing services to Miller-Tippens — not as an independent party intercepting communications for unrelated purposes.
  • Statistics and Marketing category technologies are not activated until you provide affirmative consent through the tool described in Section 4.5.
  • If you do not consent, reject non-essential cookies through the consent tool and/or use browser-level controls described in Section 4.6.

6. How We Share Information

We do not sell your personal information. We may share information with:

  • Service providers who perform services on our behalf (website hosting, analytics, email), under obligations to use it only for the purposes we specify
  • D2 Branding, our website design and maintenance vendor, which may access website analytics and back-end systems solely to provide maintenance and support, and does not use that access for its own independent marketing purposes
  • Legal and regulatory authorities, where required by subpoena, court order, or other legal process, or to protect the rights, property, or safety of Miller-Tippens or others
  • A successor entity, in connection with a merger, acquisition, or sale of assets

7. Your Privacy Choices and Rights

Cookie preferences: Manage anytime via the consent tool on the Site or your browser settings (Section 4.6).

California residents (CCPA/CPRA): You may request disclosure of the categories/specific pieces of personal information we’ve collected, request deletion, request correction, and not be discriminated against for exercising these rights. We do not sell personal information and do not share it for cross-context behavioral advertising outside the consent-gated Marketing category in Section 4. To exercise these rights, contact us using Section 10.

Other states: Depending on your location, you may have additional rights under state privacy laws (e.g., Colorado, Connecticut, Virginia, Oregon). Contact us per Section 10.

8. Children’s Privacy

The Site is intended for adult visitors — prospective clients, subcontractors, vendors, and job applicants. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

9. Data Security and Retention

We implement reasonable administrative, technical, and physical safeguards to protect information collected through the Site, though no method of internet transmission or electronic storage is 100% secure.

We retain personal information as long as necessary to respond to inquiries, evaluate job applications, comply with legal obligations, and enforce our agreements. Retention periods vary by information type and purpose of collection.
